Rules of Conduct
Spam
The act of spamming, as defined by Local Line, Inc., is the sending or distribution of large amounts of unsolicited and/or unwanted email. For your information, currently there are no Federal or State statutes and/or definitions regarding the act of spamming, however, it is Local Line’s responsibility to set definitions and disciplinary actions accordingly pursuant to Indiana State Laws.
Disciplinary action is as follows: On the first offense, a warning shall be issued by the residing Operations Security Administrator. If the Security Administrator is not available, than issuance shall be made by the Sr. Systems Administrator or CEO of Local Line. On the second offense, a second and final warning shall be issued by any one of the above mentioned Administrators with immediate suspension of said users’ account for a period not to exceed 15 days. The third offense shall result in immediate termination which shall be decided by the Sr. Systems Administrator and/or CEO of Local Line, Inc.
Denial of Service
A Denial of Service attack, or DoS attack, is defined as the malicious act of sending excessive amounts of connections to any machine located within Local Line networks and/or on the Internet in order to cause the machine or its services to act in a way that is not within normal operation procedures. Attacks that fall within this range are: SYN, Ping flooding, smurf, bonk, boink, OOB, WinNuke, and any other created attack that would cause disruption of any machine and/or service on Local Line’s networks or on the Internet.

The second offense shall result in immediate termination which shall be decided by the Sr. Systems Administrator and/or CEO of Local Line, Inc. Local Line, will prosecute DoS attacks to the fullest extent of the law.
Camping
Camping is defined by Local Line, Inc. as the act of being connected to the Internet and leaving the machine in an unattended state, i.e. starting ICQ and leaving the computer, or being connected for more then 12Hours consecutively.
Disciplinary action is as follows: On the first offense, a warning shall be issued by the residing Operations Security Administrator or Sr. Systems Administrator. On the second offense, a second and final warning shall be issued by any one of the above mentioned Administrators. The third offense may result in termination by the discretion of an acting Administrator or CEO of Local Line.
Cracking (Hacking)
Cracking is defined as the action to penetrate or control any machine on Local Line's networks or any machine located on the Internet without prior and/or authorized consent of the owner of the targeted machine. The act of cracking is taken seriously within Local Line. Any user found guilty, after the review of evidence by an Administrator or CEO, will face immediate termination of said account(s). Disciplinary action may also include state level crimes from a Class A misdemeanor of Computer Trespassing to a Class D felony of Computer Tampering as set forth in Indiana State laws. Crimes committed across Indiana state lines will be dealt with by Federal laws. Local Line, will prosecute Cracking (hacking) to the fullest extent of the law.
Harassment
Harassment is defined by Local Line, Inc. as the giving of unwanted attention, whether negative or positive. Harassment is considered a serious offense and disciplinary action is at the discretion of the Administrators and/or CEO of Local Line, Inc.
Terms and Conditions
1. Local Line services may only be used for lawful purposes. Local Line expressively forbids the transmission of any material the transmission of which would violate any US or state regulations. Such transmissions include but are not limited to: material protected by trade secret, material judges to be threatened in nature and copyrighted material. You agree to indemnify and hold harmless Local Line from any responsibilities for the accuracy or quality of information through its services.
2. Local Line exercises no control whatsoever over the contents of information passing through its systems. Additionally, no warranties of any kind, whether expressed or implied, exist for any service provided by Local Line. Local Line also disclaims any warranty or merchantability or fitness for particular purpose. Local Line will not be responsible for any damages you suffer. This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused via any Local Line service is at your own risk. Local Line specifically denies any responsibility for the accuracy, quality or suitability of information obtained through its services.
3. Notwithstanding number 2 above, you agree that should be found liable in a court of law for any reason relating to your Local Line services our liability is limited to the unused portion of your subscription fee.
You know that this system contains an unabridged copy of the information known as "Use Net", that portions of the system may contain messages which you may find offensive. Local Line does not censor or in any other way control the contents of this or any other on-line information, and that nearly all of the information found here originates on systems other than those under direct Local Line control. You are further aware that Local Line cannot confirm the proper classification of information presented in any area of the system. By giving the command(s) to view or transfer any information or file on any Local Line system, or any system reached through Local Line system, you are consenting to the display or transfer of the information presented and waive all rights and claims towards Local Line and its owners.
4. Local Line prohibits any attempts to retrieve significantly large amounts of news and/or mail from its network outside of methods specifically endorsed by Local Line.
5. Local Line prohibits any attempts to bypass its pricing structure by any means without the prior written consent of Local Line Inc.
6. Local Line reserves the right to change the rates and otherwise modify any of these Terms and Conditions by notifying you 30 days in advance of the effective date of change.
7.Local Line may discontinue any or all levels of service at its discretion. Should his occur, accounts will be refunded on a pro-rated basis.
8.You agree to indemnify and hold harmless Local Line Inc. its owners, and employees from all claims which are a result of your usage, without limitation.
9.You agree that the security of your account, including your password, is your responsibility and that all use which emanates from your account will be considered to be undertaken by you unless it can be shown to have been an unauthorized intrusion. You agree to notify Local Line immediately if you believe that your account has or is being compromised.
10. You agree to keep Local Line Inc. informed of your current legal mailing address and phone number. Local Line will not disclose this information to any third party except upon the presentation of a valid subpoena, warrant or court order.
11. Any or All of theses Terms may be altered or superseded through the use of a written agreement stating such between you and Local Line Inc.
12. You will notify us in writing or by E-Mail when you wish to cancle your account, In order to verify that you do indeed want to cancle, we require this notification.
13. Local Line, Inc. Offers "Unlimited Internet Access", which defined means: Internet Access, not restricted by time spent online, connected to Local Line, Inc.'s Available Modem Pool, for which we do not charge you, the customer, according to your time spent online, or by how much bandwidth your modem uses in that time connected.
These Terms and Conditions and Rules of Conduct supersede at previous representations, understandings or agreements and shall prevail notwithstanding any variance with Terms and Conditions and Rules of Conduct of any other submitted. Use of any Local Line service constitutes acceptance of these Terms and Conditions and Rules of Conduct.
These Rules and Terms of Service take effect 30 Days from today (1-15-200), and as revised in this document dated 1-15-2000.
